David Otunga Says Andrade Would Win If He Sues WWE Over Non-Compete Clause
Former WWE Superstar David Otunga claims WWE cannot enforce a one-year non-compete clause on Andrade.
Andrade has been absent from AEW television following his return to the company on the October 1, 2025, episode of Dynamite. Reports claimed that Andrade’s absence was due to an issue with a non-compete clause with WWE.
David Otunga, a Harvard Law School graduate and former WWE Tag Team Champion, addressed the circumstances surrounding Andrade and the possibility of WWE enforcing a one-year non-compete clause on the latter.
Speaking on his YouTube channel, Otunga claimed that there were numerous vague clauses and contradictions in the WWE contracts, and that they don’t appear to be legally enforceable.
“There is a lot to be left to interpretation and there are vague clauses. The contract is a lot of contradictions. The whole independent contractors part, it just doesn’t seem legally enforceable to me.”
Otunga claimed that if Andrade decides to challenge the non-compete clause in court, a judge would likely rule in his favor.
“If he were to take this to court, I think a judge is very likely to rule in his favor and just throw out the entire clause in the contract. You can’t prevent somebody from earning a living for an entire year.” [H/T Fightful]
Tony Khan Recently Commented On Andrade’s Status
Tony Khan recently addressed Andrade’s current status with AEW.
Khan was asked about Andrade’s absence on the WrestleDream media call by Sports Illustrated’s Jon Alba. However, the AEW President didn’t provide a concrete answer and stated that he would refer to the same comments he made about Andrade when he left the company in 2023.
“Well, I would echo sentiments I had said back at Worlds End 2023, when Andrade initially left a few years ago. And I would say I have a ton of respect for Andrade El Idolo,” Khan said. “I think he’s an amazing wrestler. And I think that when he left in 2023, it was on a very high note.”
“[That’s] just to reiterate everything I said at his departure a few years ago, and I still feel that way,” Khan added. “I think Andrade is a great wrestler and I am excited to see what’s next for him. And I would leave it at that.”
